Terms and Conditions

The Riviera dei Sogni Real Estate Agency (hereafter also referred to as Riviera dei Sogni Agency or Riviera dei Sogni Agency or just Agency) operates in its activity as a booking agency of private persons' houses.

Therefore, the Riviera dei Sogni Agency is not responsible for any delays, accidents, losses, changes of schedules and rates, damages and prejudices, etc. (neither for persons nor for objects), which may occur during one of the contracted services.

Riviera dei Sogni and its collaborators shall never be liable for:

- errors, omissions or incorrect spelling of information on the website or subsequent communication with the tenant

- false or incorrect information about third persons and owners

- damage, personal injury or injury that may occur during the booked stay in the accommodation indicated on the web pages of which the booking is managed

- discussion between the Renter and a third party

- content of external links on our website

The Riviera dei Sogni service includes the preparation and issuing of documents related to your reservation. This can be done by e-mail, by fax, by regular mail or personally in the offices of Riviera dei Sogni.

Riviera dei Sogni and its suppliers are also not obliged to make any refund in case of overbooking, force majeure or any other cause beyond their control.

The following general terms and conditions then apply and are understood to be known and accepted by the customer at the time of booking.

Booking

The customer may make a reservation of accommodation either by telephone or directly through the booking form on www.agenziarivieradeisogni.com . He can also make the reservation in person by going to the Agency or with immediate confirmation directly on the website.

The reservation is considered confirmed only upon receipt of our confirmation letter, fax or email.

Terms of payment

All payment information will be provided by the Agency when sending the booking confirmation or at the time of the booking request.

 Travel documents

Upon completion of the booking Riviera dei Sogni will send a letter, fax or email with the booking confirmation which is equivalent to the voucher to be presented when collecting the keys.

Payment, services, special conditions and information

The payment or the balance of the agreed amount, if still to be paid, together with the payment of the additional services as a lump sum of the obligatory services (which includes final cleaning, excluding kitchenette and kitchen material and equipment etc.) and eventual supply and change of linen, are to be paid to the Agency Riviera dei Sogni or to its appointed person or to the Owner of the accommodation by cash at the moment of arrival and at the handing over of the keys or in another way previously indicated by the Agency at the moment of the booking confirmation.

Failure to pay such fee will result in the automatic termination of the contract and the amount already paid at the moment of the reservation will remain acquired by the Agenzia Riviera dei Sogni as compensation. In the latter case the Riviera dei Sogni Agency will have the possibility to ask the customer to pay the whole amount for the stay as cancellation penalty which amounts in this circumstance to 100%.

The payment of additional reservation costs (heating costs, air-conditioning costs, costs for additional services such as transfers, guided tours, etc.) will be duly regulated and agreed by the Riviera dei Sogni Agency with the customer at the time of the service request.

From the amount thus calculated, all possible and further sums claimed for any reason by the Renter are excluded.

In the description of the accommodation or after the booking request or when confirming the booking, it is indicated whether bed linen, kitchen linen and towels are available, or must be brought by the customer, or whether they can be hired on site. Normally, the accommodations are equipped with all kitchen utensils, but not with bed linen and towels. If bed linen and/or towels can be hired on site and the customer wishes to enjoy the service, this must be requested at the time of booking. In some cases kitchen linen is provided by the landlord, but it is advisable to bring it from home. Likewise, it is necessary to bring detergent and toilet paper from home.

The accommodation description states whether additional beds or cots are available. As a rule, bed linen for the cot must be brought by the guest. The customer is asked to check whether the cot is included in the maximum number of occupants or whether it is possible to exceed the maximum capacity of the accommodation stated in the description through the availability of the cot. Additional beds and cots must in any case be ordered at the time of booking and confirmed if necessary. A corresponding note must also be included on the booking confirmation.

For each accommodation where it is possible to bring pets, the customer will find explicit mention of this in the detailed description of the advertisement. The presence of pets, their species and size must in any case be communicated by the customer at the time of booking, even if the accommodation description explicitly permits them. Permission is always valid for one animal only.

The exclusion of pets from the description does not guarantee that no pets will be found, even temporarily, in the holiday home, holiday village, residence etc. or in the accommodation booked by the customer. This may be due to the nature of the holiday village or privately owned accommodation, to which no imposition can be made in this respect, or to the fact that the owner of a holiday property in a rural region keeps a pet himself and wishes to avoid conflicts with foreign animals.

If pets are explicitly permitted, they do not necessarily have full freedom of movement. Dogs are forbidden access to swimming pools and green spaces. In almost all countries a European pet passport (dogs and cats) with certification of rabies vaccination is compulsory or recognised. Often a microchip with an identification number or a tattoo is also required. For certain breeds of dogs, mostly so-called fighting dogs, strict regulations apply in many countries. In some countries they are generally banned. You should find out about this in good time from your vet or on the Internet.

In the accommodation you will find complete cutlery and crockery, in a number appropriate to the number of persons in the booking. A refrigerator is also part of the equipment and is therefore not mentioned in the accommodation description. All other electrical appliances such as an oven, microwave, dishwasher, coffee machine or washing machine are only available if explicitly mentioned in the description.

The word 'TV' in the description of the accommodation generally indicates a colour television set. In the event that the TV signal is received via cable or satellite, "satellite TV" or "cable TV" is indicated in the text. However, this is no guarantee that channels in the customer's language are available.

If garden furniture is mentioned in the accommodation description, there is no guarantee that a chair will be available for every customer. This also applies to deck chairs, which are often only available in limited numbers. For hygienic reasons, many landlords do not provide cushions for deck chairs. Deck chairs and parasols are also only available if mentioned in the description.

The accommodation description mentions the presence of a swimming pool, if any, and generally indicates its opening period. However, the beginning and end of the pool opening period may vary depending on weather conditions. Special opening times and regulations often apply to swimming pools. The regulations may contain specific obligations and prohibitions, such as the prohibition of wearing Bermuda shorts in the pool, the use of balls, mattresses and the like, or the requirement to wear a swimming cap (frequent in Italy).

The customer is entitled to use the accommodation in its entirety, thus including the furnishings and all items of use. However, he/she is obliged to use the accommodation, its furnishings and any communal equipment with the greatest possible care. Any damage occurring during the stay, caused by guests or their guests, shall be charged to them.

In the case of special offers or discounts on the rental price, promotions such as discounts for first-minute bookings or special offers for families or senior citizens, any variable ancillary costs pertaining to the entire length of stay must be paid. If the special offer extends over a period of time in which there is a change of season, the discount is always calculated on the basis of the lowest weekly or daily price.

Arrivals and departures

The handover of the keys of the accommodation will take place starting from 3 p.m. on the day of the beginning of the stay by the Riviera dei Sogni Agency or the Owner or other person in charge at the property or other place previously or subsequently indicated. The exact time for picking up the keys of the property is indisputable and will be communicated in time by the Riviera dei Sogni Agency.

Should the guest be delayed, he/she is kindly requested to inform the Agency or the owner in time, who will try to organise the reception also outside the normal time (possibly on payment of a fee).

In the event of a delay, please inform the Riviera dei Sogni Agency in good time.

The contractor shall have to be in possession of an identity card and travel documents.

The exact time for the return of the keys of the property is undisputable and will be communicated to the Renter when he picks up the keys on arrival or at a later time (normally between 9.00 a.m. and 10.00 a.m. on the day of check out). The return of the keys will take place on the last day of the rental period at the property itself in the hands of a person appointed by the Riviera dei Sogni Agency or by the Owner himself/herself after checking the cleanliness of the kitchenette, the pots and pans, the crockery, the electrical appliances and the barbecue and any damage to the property and the furniture. The accommodation, however, must be left by the clients in the same orderly and clean condition as when they took possession of it.

Therefore, the kitchenette, dishes and barbecue must be left perfectly clean, the refrigerator empty and the flat free of rubbish.

Failure to comply with this rule will result in the client having to pay an additional charge to be determined when checking the condition of the accommodation.

In the event that you are unable to occupy the flat on the day booked or at the agreed time due to personal reasons, strikes, or difficulties during the trip, no reimbursement will be made. The same rule also applies in the case of early departure.

Cancellation of the contract by the traveller

The customer has the right to cancel the booking at any time before the beginning of the stay. The date of arrival at Riviera dei Sogni of the cancellation notice is decisive for the calculation of the cancellation fee. In the interest of the customer, it is recommended to communicate the decision of cancellation in writing.

Therefore, in case of cancellation, notice of cancellation and/or early termination of the contract by the tenant, the tenant shall be liable under the following conditions

a) Up to 15 days before the start date of the tenancy: cancellation free of charge;

b) From the 14th day until the day of the start of the stay: loss of any deposit paid and balance of the previously booked stay.

The renouncing customer has the right to be replaced by another person, provided that he/she gives Riviera dei Sogni, as travel organiser, binding notice prior to departure in time for the necessary changes to be made. The replacement person must also meet all the requirements of the trip and no regulations or legal provisions shall prevent the replacement. Upon confirmation of the change of name by the travel organiser, the transferee customer takes over the transferring customer for all purposes. Riviera dei Sogni is entitled to charge the renouncing customer an amount of Euro 20.00 per booking for the expenses incurred to make the substitution. Nothing prevents the customer from trying to prove to Riviera dei Sogni that the damage caused by the substitution is null or less than the sum charged.

Alternative or cancellation of the contract

The Riviera dei Sogni Agency or the Owner in any case reserve the right to replace the booked flat with one of equal value in case of a serious unforeseen event which cannot be reasonably foreseen. In case of force majeure, wars, calamities and the like, the Riviera dei Sogni Agency or the Owner can cancel the reservation returning the amount received.

With the acceptance of the present contractual conditions the Renter in case of termination and/or early cancellation of the booking by the Agenzia Riviera dei Sogni expressly renounces to the request of further sums as compensation for damages and/or any other title.

Deposit

At the handover of the property the Tenant will pay to the Agenzia Riviera dei Sogni, to the Owner or to another appointee, as a non-interest bearing security deposit, the sum of Euro 200,00 in cash which will be given back at the end of the lease, after checking for possible damages to the property and furniture and for the cleaning of the kitchenette and its appliances and equipment as above mentioned. However, in certain cases and subject to prior notice to the Tenant, the Riviera dei Sogni Agency reserves the right to ask for a higher sum than the above as a deposit.

In case such payment is not made or is made in a different way from the previously mentioned ones the Owner or the Riviera dei Sogni Agency reserve the right not to hand over the keys.

Obligations of the Tenant

The occupancy of the accommodation unit is limited to the number of persons mentioned at the time of booking.

The Riviera dei Sogni Agency, the Proprietor or another person in charge, may forbid the entry of excess persons or ask for a surcharge in case the number of occupants is higher than the number mentioned at the time of booking.

In the event of damage or any breakage to objects or property, these shall be compensated at the list price.

The cleaning of the kitchenette and its appliances, crockery and kitchen equipment must be carried out by the customer as it is not included in the service package that includes the other final cleaning; otherwise a sum of Euro 30.00 will be charged.

Early departures must be communicated to the Riviera dei Sogni Agency, its appointee or the Owner at least 3 (three) days in advance in order to facilitate the check of the flat.

The Renter declares that he/she will observe the rules of good neighbourliness, the conduct of a good family man and any condominium regulations or the use of condominium facilities.

Each flat shall be provided with an inventory list. The Tenant shall report to the Riviera dei Sogni Agency, the Owner or other person in charge within 2 (two) hours from the handover of the keys any observations regarding the cleanliness of the accommodation and within 48 (forty-eight) hours any defects of the property and furnishings including electrical appliances; in the absence of reporting, any defects and non-conformities shall be presumed to be known and considered irrelevant for the usability of the property for the purposes agreed in the contract, and subsequently any damaged or broken items shall be compensated.

Liability attributable to the Riviera dei Sogni Agency or the Owner

All accommodation is delivered clean and in good condition. The houses, despite having different characteristics from each other, are always equipped with a functioning and equipped kitchen or kitchenette (pots, dishes and refrigerator). Bed linen, towels, television, washing machine, dishwasher, air conditioner etc., when available, are indicated in the property description. Therefore specific needs must be clearly stated when making the booking request. In any case, each house is rented as it is described on the website www.agenziarivieradeisogni.com and the latter is authentic for any discrepancies.

Should the characteristics of the accommodation be substantially different from what is stated in the contract, such that it does not allow an adequate stay, the Riviera dei Sogni Agency or the Owner undertake to do what is reasonably within their possibilities to provide the Renter with an alternative of equal quality and/or reasonably solve the inconvenience.

Should the Renter unjustifiably refuse the proposed alternative, the contract will be considered terminated without the reimbursement of any money.

Cases in which the Riviera dei Sogni Agency or the Owner are not responsible

The Riviera dei Sogni Agency or the Owner of the accommodation unit are in no way liable for any damages, accidents, thefts, non-potable water supply and inconveniences in general which may occur in the Property during the tenant's stay.

Prohibition of assignment

It is forbidden to assign any rights to Riviera dei Sogni to third parties. It shall also be considered unlawful to exercise in court the rights of the Traveller presented by third parties in his/her own name.

Insurance

The services of Riviera dei Sogni do not include any insurance. We recommend taking out travel cancellation insurance with a wide range of insurance benefits at the time of booking.

In general, private liability insurance also settles damages caused by the customer in holiday homes and holiday flats. It is advisable to check whether the liability insurance also covers damage caused by the client abroad.

Health, visa and passport regulations

EU citizens need a valid passport or identity card to enter Denmark, Finland, France, Ireland, Italy, Croatia, the Netherlands, Norway, Austria, Portugal, Sweden, Switzerland, Spain, the Czech Republic and Hungary. Children under the age of 16 require an individual ID card or must be entered in the passport of one of their parents. An exception is the Czech Republic, where minors aged 15 and over require an individual ID card with photograph.

All travellers to the United States require a machine-readable passport valid at least until the date of departure. In addition, since 12 January 2009 every traveller who can enter without a visa is obliged to obtain an electronic entry authorisation at https://esta.cbp.dhs.gov/esta/.

There are currently no special health regulations. The customer is personally responsible for complying with all regulations relevant to the execution of the trip (travel documents, vaccinations, customs and currency regulations, possibly pet travel regulations). All inconveniences arising from non-compliance with these provisions, in particular costs arising from cancellation of the trip, shall be borne by the customer.

Citizens of countries outside the European Union are advised to inquire at their consular authorities.

Jurisdiction

The resolution of any dispute arising from or in any way connected with the execution, interpretation or termination of the contract and the booking will be submitted exclusively to the jurisdiction of the Court of Imperia.
